AUSTIN, Texas
, March 2 (UPI) -- Gov. Rick Perry led among Republicans and
former Houston Mayor Bill White won the Democratic
gubernatorial primary in Texas Tuesday, early returns
indicated.
Perry -- who held a sizable lead in pre-election polls over
U.S. Sen. Kay Bailey Hutchison and newcomer Debra Medina --
took an early lead in the primary election as returns began to
come in. But it remained to be seen whether he would collect
enough votes to avoid an April 13 runoff, the Houston
Chronicle reported.
Perry's polling numbers have ticked toward the 50 percent mark
in recent weeks, but experts say Medina -- who's been steadily
tracking in the teens -- may play spoiler and force a runoff
between Perry and Hutchison, whose numbers hovered in the
upper 20s.
White was favored in the seven-person race to win the party's
nomination for governor in the Nov. 2 general election. His
nearest competitor was Houston hair-care magnate Farouk Shami.
Things are done big in Texas, and Tuesday's ballot was no
exception. Besides choosing who will face off in November to
be the state's chief executive, Texans will cast votes for all
32 U.S. representatives, a slew of statewide offices, three
state Supreme Court justices, three Court of Criminal Appeals
members, 16 state senators, all 150 state representatives,
eight members of the state Board of Education, several Court
of Appeals justices, district judges, family district judges,
county-level judges and many county-level races, the Houston
Chronicle reported.
The Justice Department said in a statement Monday it will
monitor balloting in Fort Bend, Galveston, Gonzales,
Williamson and Wilson counties to ensure compliance with the
minority language requirements of the Voting Rights Act of
1965 and other federal voting rights statutes.

ATLANTA SAW MILL CATCHES FIRE
By Robert DelGiorno
2/28/10, 9 a.m.
ATLANTA, Texas- The Anthony Forest Products Co., Saw Mill in
Texas caught fire Saturday night around 8:30 p.m. and Atlanta
fire fighters were still extinguishing the fire at 8:51 a.m.
Sunday morning. “The main processing mill caught fire but
nobody was hurt and everything went smoothly,” Atlanta Fire
Chief Robin Betts said.
The Atlanta Fire Department has not determined what caused the
blaze.
“We are going to look into it as soon as we get all of our hot
spots knocked out and probably use the resources of Alcohol,
Tobacco and Firearms to determine the actual cause of the
fire,” Chief Betts said.
ATF investigators are already at the scene of the fire trying to
determine the cause of the fire. The Anthony Forest Products
Atlanta location employs 100-249 people and produces annual
revenue of $20 Million to $50 Million, the company website
said.
The question is: will the plant remain open at full capacity
after the fire is completely put out and repairs are made to
the main processing plant.
KPYN news will attempt to contact the plant manager sometime
Sunday for his comments on the blaze and the future of the
plant.

Waits on trains crossing Farm-to-Market Road 3129 between
US 59 and the International Paper Mill in Domino will soon end

“We will be constructing bridge over the Union Pacific
Railroad and County Road 3676,” said Kenny Icenhower, area
engineer for TxDOT in Texarkana. “The overpass will be
constructed on a new location just north of the current
highway so traffic will continue to use the highway while the
structure is being built. County roads affected by the
overpass will be rerouted to connect with the new roadway.”
The bridge will have two 12-foot traffic lanes with 10-foot
paved shoulders on each side.
East Texas Bridge, Inc. of Longview was awarded the contract
for the project with a low bid of $3.9 million.
Work on the overpass should begin in April of this year and

Jobless Taxpayers
May Be Missing Key Tax Breaks, Costing Themselves Money
Survey
shows 73 percent don't know unemployment benefits are taxable
Atlanta, TX. – The unemployment rate for
2009 hit 9.2 percent, but taxpayers are still confused about
whether unemployment benefits are taxable and job search costs
are deductible, according to a new survey by H&R Block. As a
result, taxpayers could be surprised at tax time. "Not knowing
how much you have to pay on unemployment benefits or what you
can deduct for job hunting expenses could be costly at tax
time," said . "There are several new tax breaks for 2009, and
job search expenses that can mean savings for taxpayers who
were out of work." The survey assessed the tax knowledge and
opinions of a nationally representative sample of 898
taxpayers.
Are unemployment benefits taxable?
According to the survey, 73 percent of taxpayers didn't know
if or to what extent unemployment benefits are taxable. A tax
break in the 2009 Recovery Act exempts the first $2,400 of
unemployment benefits received that year from federal taxes.
However, unemployment benefits over that amount are taxable.
What qualifies as job search expenses?
Taxpayers were confused about what qualifies as job search
expenses. According to the survey, 40 percent of taxpayers
didn't know they could deduct transportation expenses or the
cost of help with a resume. Another 17 percent mistakenly
believed they could deduct wardrobe purchases, the survey
showed. "If you're paying someone to help compile your
resume, using a head hunter or traveling for an interview, you
can likely deduct those job search related expenses. But
wardrobe purchases or hair cuts aren't deductible," said.
"Generally, if you can use it for another purpose, it will not
qualify as a job search related expense."
Taxpayers who relocate because of a new job can deduct your
qualified moving expenses without itemizing. The new job must
be at least 50 miles farther away than the previous residence
was from the old job and taxpayers must remain at the new
location at least 39 weeks.
Which life event impacts you the most?
Perhaps as a sign of the economy, the survey showed that
taxpayers ranked losing their job as the life event that would
most impact their taxes, at 56 percent. That life event ranked
higher than having kids, at 22 percent; getting married, 9
percent; or getting divorced, 8 percent.

AAA Texas
issued recommendations to drivers of recalled
Toyota’s yesterday. Tuesday, Toyota Motor Sales
announced it was instructing dealers to temporarily suspend
sales of eight models involved in the recall for sticking
accelerator pedals. AAA says that if owners of the recalled
vehicles notice any problems with their accelerator, it is
hard to depress, slow to return or is unsmooth during
operation, you drive the vehicle to the nearest safe location,
shut the engine off and contact their local Toyota dealer for
assistance. If a motorist experiences a stuck accelerator
pedal while driving any vehicle, AAA recommends the following:
-
Stay calm, but act quickly.
-
Keep looking at the road ahead. Looking away from the road
to see what’s wrong with the pedal will greatly increase the
chances of a crash.
-
Be sure the foot is completely off the accelerator. Some
stuck accelerator crashes have later been found to be the
result of an honest mistake—the driver thought he or she was
pushing on the brake.
-
Put the vehicle’s transmission in neutral or, in a vehicle
with standard transmission, depress the clutch. Do NOT turn
off the engine. Doing so will cause the power assist to
steering and braking to disengage and make it difficult or
impossible to steer, and harder to brake. Turning the key
too far could possibly lock the steering wheel.
-
Steer the car to a safe place and stop, and then turn off
the engine. If stopped by the side of a road, turn on
emergency flashers and put out flares or reflective
triangles. If unable to get the vehicle off the roadway,
allow it to come to a stop and turn on emergency flashers.
Do not restart the vehicle.

Texas Governor Rick Perry
is accusing President Barack Obama of trying to take over
state public schools with the presidents proposed “Race to the
Top” Education program which Governor Perry said allows school
districts to circumvent the state’s decision not to compete

currently only available to states but Governor Perry said
that the program would let local school districts compete
directly for funding down the road. Perry is against the Race

of the federal stimulus program that would have given
Texas $555 Million for an unemployment fund; Perry tuned that

Rely on expert opinion when it comes to evaluating a charity.
Be wary of claims that 100 percent of the donations will
assist relief victims. Be cautious when giving o line. Find
out if the organization has an on-the-ground presence. Find
out if the charity is providing direct aid or raising funds
for other groups. Gifts of clothes, food or other in-kind
donations, while well intended, may not be the quickest to way
to help.

Cass County Texas is in the middle of an artic blast, for
Cass County’s news leader, KPYN AM-FM and KPYN Dot Net, I’m

Last night, the temperature in
Atlanta dipped to 15 with a wind chill of zero. According to
the national weather service in
Shreveport, the temperatures in
Atlanta will get even colder tonight, with the low expected to
drop to 13.
Larry Trevino, Cass County Emergency coordinator said that
everyone should check on neighbors especially the elderly to
make sure that they’re ok tonight.
The number for the Cass County Sheriff’s Department is
903-756-7511.
The extremely cold weather poses a danger for the homeless.
The 86 cots’ at the Randy Sam’s Outreach Shelter in
Texarkana was over flowing last night. All of the cot’s were
filled and some people seeking shelter had to sleep on
blankets on the floor. Shelia Wilhite with the Shelter said
that anyone without shelter tonight needs to get out of the
cold.

AAA Texas Offers Tips for Safely Starting a Vehicle In
Winter Weather
(Irving, Texas; January 7,
2010) - As Texans brace for the arctic blast expected over the
next few days, AAA Texas wants to share a few car care basics
that may help families and commuters safely start their
vehicle in severe winter weather.
These are things that should
be checked or avoided to prevent problems, specifically in
cold conditions:
-
Have
coolant levels and mixtures checked.
Make sure that you have the proper anti-freeze/water mixture
to prevent frozen coolant. When water freezes, it expands
and has the potential to crack the radiator and other engine
components.
-
Check the
car battery.
Batteries tend to fail when it is below freezing.
-
Check your
windshield washer fluid freeze point.
Frozen washer fluid could damage washer fluid hoses and the
tank. There are washer fluids available that are made
with low freeze points and de-icer.
-
Make sure
your windshield is defrosted before turning on your wind
shield wipers.
When your wipers are frozen to the windshield the stress can
damage the wiper components.
-
Check your
tire pressure.
When the temperature drops so does the air pressure in your
tires. Driving with tires that are under or over
inflated can lead to flat tires and blowouts on the road.
-
Make sure
windows are defrosted before trying to roll them down.
The stress from attempting to roll down a frozen window can
lead to internal window component failure.

Avoid Home Damage from
Frozen Pipes
AUSTIN – Texas weather can change quickly, especially in the
winter. A fast-moving cold front can cause temperatures to
drop below freezing within hours. Outdoor pipes, pipes in
unheated areas, and pipes that run along uninsulated exterior
walls can burst if the water in them freezes and expands. This
can shatter pipe seals or the pipes themselves, sending water
pouring through your house. You can avoid thousands of dollars
of damage to your walls, ceilings, carpets, and furniture by
taking a few simple measures to protect your home.
Before the Freeze
• Protect faucets, outdoor pipes, and exposed pipes in
unheated areas by wrapping them with rags, newspaper, trash
bags, or plastic foam.
• Insulate your outdoor water meter box and be sure its lid is
on tight.
• Cover any vents around your home’s foundation.
• Drain and store water hoses indoors.
• Protect outdoor electrical pumps.
• Drain swimming pool circulation systems or keep the pump
motor running. (Run the pump motor only in a short freeze.
Running the motor for long periods could damage it.)
• Drain water sprinkler supply lines.
• Open the cabinets under sinks in your kitchen and bathrooms
to allow heated indoor air to circulate around the water
pipes.
• Set your thermostat at a minimum temperature of 55 degrees,
especially when you’re gone for the day or away for an
extended period.
• Let indoor faucets drip; it isn't necessary to run a stream
of water.
• Make sure you know where your home’s shut-off valve is and
how to turn it on and off.
• If you leave town, consider turning off your water at the
shut-off valve while faucets are running to drain your pipes.
Make sure you turn the faucets off before you turn the
shut-off valve back on.
• If you drain your pipes, contact your electric or gas
utility company for instructions on protecting your water
heater.
If Your Pipes Freeze
• If a pipe bursts and floods your home, turn the water off at
the shut-off valve. Call a plumber for help if you can’t find
the broken pipe or if it’s inaccessible. Don’t turn the water
back on until the pipe has been repaired.
• If the pipe hasn’t burst, thaw it out with an electric
heating pad, hair dryer, portable space heater, or towel
soaked with hot water. Apply heat by slowly moving the heat
source toward the coldest spot on the pipe. Never concentrate
heat in one spot because cracking ice can shatter a pipe. Turn
the faucet on and let it run until the pipe is thawed and
water pressure returns to normal.
• Don’t use a blowtorch or other open-flame device. They are
fire risks and carbon monoxide exposure risks.
If You Have a Loss
• Contact your insurance agent or company promptly. Follow up
as soon as possible with a written claim to protect your
rights under Texas’ prompt-payment law.
• Review your coverage. Most homeowners and renters policies
pay for property repair. In addition, most policies pay for
debris removal and for additional living expenses if you have
to move temporarily because of damage to your home. If you
can’t find your policy, ask your agent or company for a copy.
• Homeowners policies may require you to make temporary
repairs to protect your property from further damage. Your
policy covers the cost of these repairs. Keep all receipts and
damaged property for the adjuster to inspect. If possible,
take photos or videos of the damage before making repairs.
Don’t make permanent repairs. An insurance company may deny a
claim if you make permanent repairs before an adjuster
inspects the damage.
• Most homeowners policies do not cover loss caused by
freezing pipes while your house is unoccupied unless you used
reasonable care to maintain heat in the building; shut off the
water supply; and drain water from plumbing, heating, and air
conditioning systems. Questions? If you have questions about
insurance, call TDI’s Consumer Help Line toll-free:
1-800-252-3439 or visit the TDI website: www.tdi.state.tx.us.
Assistance is available in both English and Spanish.

Wrapping Pipes Can Save Money
By: Christy Green
Atlanta, TX-
Jason Everett from Everett's Plumbing in Atlanta is advising
property owners to take proper precaution during the
below-freezing temperatures of 16 to 17 degrees that the
national weather service is forecasting to hit Cass
County on Thursday and Friday night.
"Wrapping household pipes that are exposed to the cold air
will help save money by preventing pipes from freezing and
busting," Mr. Everett said."
There is about a 100 percent chance of pipes freezing when the
temperatures drop this low with the wind blowing."
Everett also stated that the best thing to do is keep pipes
covered with insulation that can be purchased at the hardware
store, and also by placing a bucket over the hose bib outside.
Everett's Plumbing offers a service where they go to homes or
businesses and help those in need of winterizing, either by
wrapping pipes, installing heaters, running gas lines,
performing gas inspections, and installing gas fire-places.

Bulb Recycling Program
For immediate release:
With the delivery of the new recycling carts and launch of the
City’s enhanced recycling program, it is important for
residents to note that fluorescent light bulbs or tubes (CFLs)
are not accepted in the recycling carts and cannot be placed
in waste containers. If broken, fluorescent bulbs emit

commitment to the environment and sustainability by launching
a national in-store, consumer compact fluorescent light (CFL)
bulb recycling program in all 1,969 The Home Depot locations.
This free service is the first such offering made so widely
available by a retailer in the United States and offers
customers additional options for making environmentally
conscious decisions from purchase to disposal.
At each The Home Depot store, customers can
simply bring in any expired, unbroken CFL bulbs, place them in
a plastic bag and deposit them both into the orange collection
unit. The CFL receptacle will be at the front of the
store near the entrance – by the Returns desk or near the exit
doors inside the store. The bulbs will then be managed
responsibly by an environmental management company who will
coordinate CFL packaging, transportation and recycling to
maximize safety and ensure environmental compliance.

Special Christmas Tree Vandalized
For immediate release:
The beautiful lighted Christmas tree at the
entrance to Spring Lake Park which was donated to the
community by generous, long-time resident Charles Russell was
vandalized over the past weekend. “The tree was fine
when we held the Jingle Bell Run at Spring Lake Park on
Saturday morning and I went by to check on it on Saturday
evening and it looked wonderful,” advised Texarkana, Texas
Parks and Recreation Manager Robby Robertson. “First
thing this (Monday) morning, one of our Parks employees
reported that vandals had attempted to remove the lights from
the tree. The lights are attached to the tree with twist
ties to keep them in place, so when they couldn’t pull them
from the tree, they obviously used something to cut the
strings of lights.”
Surveillance video from a camera in place to
cover the tree is being reviewed. Due to its enormous
size, an additional camera has now been installed to protect
the tree from further harm.
“While it’s very disheartening that anyone
would want to damage such a beautiful Christmas symbol, our
Parks Department personnel are out today repairing the
damage,” Robertson noted. “Due to fuses being blown when
the light strings were cut, we may have to completely redo the

Citizen Donates Special Christmas Tree
For immediate release:
As in the saying “If life gives you lemons, make lemonaid”, a
generous Texarkana, Texas citizen has done just that.
When Charles Russell realized that a beautiful cedar tree
would need to be removed from his property when Morris Lane is
extended in 2010, rather than complain, he offered the tree as
a gift to the community to be enjoyed by everyone this
Christmas season.
The cedar tree grew beside the Russell’s
Pleasant Grove home for more than thirty years. “I’ve
watched the tree grow and taken care of it for a long time –
even knocked ice from it during the ice storm so it wouldn’t
lose its limbs,” recalled Charles Russell. “But when I
knew the tree would have to be cut when Morris Lane is
extended because it’s in the right of way, I didn’t want it to
simply go to waste.”
Daughter Trish Russell Reed also has fond
memories of the tree. “We grew up together. I’m
proud that Dad had the idea to share our wonderful tree with
the community,” Reed added.
Thanks to Mr. Russell’s generosity, the tree
now stands at the entrance to Spring Lake Park off North Park
Road near the rock towers. Texarkana, Texas Parks
Department personnel have decorated it with lights so the
community can enjoy this wonderful gift.
City of Texarkana, Texas Demolition
Inspection Process Modified
For immediate release:
Effective October 1, 2009, the City of Texarkana, Texas
modified the demolition process to provide for a systematic
identification and inspection of all properties throughout the
city. “This process marks a departure from the reactive
(complaint driven) process used in the past,” explained
Community Redevelopment and Grants Executive Director Craig
Lindholm. “We will continue to respond to citizen
complaints concerning substandard properties and code
violations, but we will attempt to address the problem
properties before they reach the ‘complaint’ stage.”
“The City’s efforts to improve the inspection process have
been ongoing for the past four years,” noted Community and
Public Works Executive Director Shirley Jaster.
“Protecting our citizens from substandard housing conditions
has always been a concern of the City. Now we have
revised ordinances in place that make enforcement of standards
much easier.”
Following the establishment of Phase 1 Target Area boundaries,
in October, 2009, City Building Officials began the review of
structures in the Rose Hill neighborhood with boundaries as
follows: North – New Boston Road; South – 7th
Street; East – Summerhill Road; and West – Robison Road.
The Rose Hill area was selected as the first area in which the
City would concentrate its efforts to complement the
redevelopment of the neighborhood which includes the new Oaks
townhomes through Hope VI grant funding. By
concentrating on one neighborhood at a time, maximum impact
can be achieved.
With an estimated 60%+ of the homes in the Rose Hill area
being rental properties, it is the City’s mission to protect
tenants from substandard structures. “Investment
property owners committed to providing decent, safe,
affordable rental housing are welcomed as partners with the
City,” Lindholm stated.
Approximately 150 houses in the Rose Hill neighborhood have
been inspected using City Building Codes as inspection
criteria in the past few days with approximately 40 being
tagged as substandard. It is anticipated that more
structures in the area will be tagged as inspections continue.
Texarkana, Texas Police were dispatched last
night at approximately 7:54pm to an armed robbery call just
occurred in the 3200 block of Robison Road. According to
information gathered at the scene, two black males approached
a white male and a white female, pointed what they believed to
be a handgun at them, and demanded money. Once they complied
with the demand, the suspects fled the area in a purple
colored vehicle. Ironically, one of the victims recognized one
of the suspects and was able to identify him as 18 year old
black male Derodrick Nelson of Texarkana, Texas. Investigators
and officers began searching for Nelson and ultimately located
him four hours later in Wake Village. He was subsequently
arrested and charged with Aggravated Robbery, a felony in the
State of Texas. He is currently in the Bi-State Jail where he
received a $75,000 bond. The investigation is open and ongoing
and more arrests are expected in this case.

I
am running for Chief Justice because I have thirty six years
of experience in helping people obtain justice in our courts.
I am running on my own merits and record. A Chief
Justice should be a seasoned, broadly experienced candidate
who knows the ins and outs of the legal system, having seen it
firsthand from every perspective. I have.
Over my 36 year career, I have tried scores of jury trials, too
many to count, in virtually every kind of case in the civil
and criminal fields of Texas Jurisprudence. I am qualified. I
am experienced. I am seasoned. I care about people, indeed I
love people. I have seen the jams into which they get
themselves. I can administer both justice and understanding to
all of the people.
The incumbent indicated on the trial experience forms that he filed
with the governor’s office that he has, during his career,
tried only two jury trials and one criminal case. Until his
appointment in 2002, he had been a document lawyer for banks
and commercial concerns.
I want to serve the people as a seasoned jurist. We need more
seasoned people making important decisions. I want to return
to Texas what Texas has done for me. I love Texas. I love the
standards of northeast Texas. I know what the people believe.
I know what they really desire for their community. I believe
as they do. I desire the same liberties and privileges they
desire.
Many voters are unaware that the incumbent became Chief Justice in
2002 as a political appointment rather than through the voice
of the voters. In 2001, the incumbent’s father contacted the
governor’s office, many months before Chief Justice Cornelius
submitted his notice of retirement to the governor in
mid-2002. His father asked the governor to appoint his son to
be the next Chief Justice. (A copy of that letter may be
obtained from the governor’s office.) The Governor
complied with Mr. Morriss' request.
When Chief Justice Cornelius retired, he continued to work on the
Texarkana Court of Appeals for many months after the incumbent
was appointed. As a matter of fact, former Chief Justice
Cornelius presently continues to write opinions for the
Texarkana Court of Appeals. (This is easily verified. Just go
to
www.texasbarcle.com/CLE/CDSearchResults.asp and type in
"Cornelius" in the search engine for all types of cases in all
fields of practice.) You will discover that former Chief
Justice Cornelius has written over 141 opinions, almost all of
which have been written since Justice Morriss was appointed
Chief Justice by the governor in 2002.
Former Justice Grant also continues to write opinions for
the 6th District Court of Appeals. Those former
Justices are paid for the work they do. They are not
volunteers. Yet the incumbent boasts that the Texarkana Court
of Appeals, for three out of the last four years, has the
shortest turn around for decisions on cases submitted to the
14 Courts of Appeals in Texas. It appears that those
calculations include the work of former justices of the
Texarkana Court of Appeals.
I am willing to speak boldly against those misguided standards that
have been foisted upon us—standards that we do not want,
standards that our Christian Community has never and hopefully
will never embrace. I stand for the proposition that the
Christian voice is as much entitled to mold the standards of
society as any other voice. In the last few decades, the
Christian voice has been scooted off the stage of political
activity by misguided judicial decisions. Separation of Church
and State does not mean, and has never meant, and should never
mean that the religious voice has no right to be heard, and no
right to influence all segments of government—legislative,
executive and judiciary. The voice of reason, the voice of the
faith of our fathers, the true voice of the people, must be
re-enthroned as the guiding light of our society.
Also, I want my eight children and seventeen grandchildren to enjoy
the same privileges of freedom and worship that I have
enjoyed. I want to preserve for them and for the posterity of
us all, the rights of life, liberty, property and the pursuit
of happiness upon which this nation was founded. These are
reasons why I am running.
